The fine relating to the manufacturer's global emissions scandal dates from December 2019.
As in other geographies, the court found that Volkswagen had breached Australian consumer law by fitting cars sold Down Under with a so-called 'defeat device' to trick the equipment used to measure harmful emissions from its motors.
Th judges said the company had given false representations about its compliance with its diesel emission standards which is against the law.
Volkswagen appealed that ruling and asked for a reduction of the fine to the A$75m which it had agreed with the Australian Competition and Consumer Commission and which the company itself considered “fair”.
